Mirasol at Coconut Point Broker Policy

Broker Policy:

Exclusive Listing Agent: Downing Frye Realty, Inc. is the Exclusive Listing Agent for the Initial Phase of Mirasol at Coconut Point.  The Initial Phase includes Buildings 9,10,11,12 as shown on the site plan.  Any broker policies for additional phases are under the control of DR Horton at the Sales Center at Mirasol. 

However, Downing Frye Realty, Inc. wishes to fully cooperate with all licensed real estate brokers and their agents in execution of sales contract for any of the units in the Initial Phase. Certain units may be entered into the Multiple Listing Service and may represent a selection of the total inventory. Not all units may be for sale at the same time. Consult the Listing Agent for a complete of all current and future units to be released.  Downing Frye Realty, Inc. as a member of the MLS shall be bound to the policies of the stated compensation in any MLS listings.  Downing Frye Realty, Inc. is also bound by the Professional Standards as a member of the National Association of Realtors, Florida Realtors, and the Naples Area Board of Realtors and any cooperating boards.

Terms: Registration: Brokers may bring their customer to the open house reception center and complete a prospect registration form or Broker's may register clients via facsimile prior to any visit to the community by the client. A Broker registration will not be honored for clients who previously registered as a visitor at an open house and currently working with an  open house agent who  has established a relationship with the client..  We cannot protect your customer from being registered by another broker. If more than one broker has registered a customer, any commission due will be paid to the broker who is the procuring cause of the sale. Brokers should become familiar with the Brokerage Policies of the Current Developer (DR Horton) including the specific registration policies for registration.

Compensation: Brokers will be paid a commission of 3%. The commission will be due or payable to the broker. The commission does not any furniture packages, lease back fees or incentives included in the contract. The commission will be paid in full at closing. Any compensation for future phases are not covered under this policy and broker should contact Current Developer.

Cancellation: If a broker's client cancels a purchase contract or defaults, no commission will be due or payable to the broker.

Showing: The Open House sales associates are responsible for providing the customer with the presentation of the inventory in the Initial Phase of Mirasol.    However, all showings for future phases are under the control of DR Horton and the DR Horton Sales Agents (located at the Sales Center or models) will present all future phases in the community.

Contracts: The community sales associate will prepare the contracts.  The Broker is responsible for assisting in arranging any financing for the customer as well as assisting in closing of the transaction.
